Foster Care on Trial: Liability, Litigation and System Reform

Abstract

In recent years, advocates have increasingly turned to litigation as a strategy to achieve broad-based change in the child welfare system, particularly for children in foster care. A number of lawsuits have been brought before the federal courts against child welfare agencies on behalf of children in foster care, raising considerable implications for agency policy & practice. Here, discussed are challenges for agencies when confronted with such litigation, including the legal basis for suit, the standard for determining agency liability, the availability of immunity for agency & staff, & the potential outcome of litigation, especially in those cases seeking to implement broad system change.
