The Impact of Liability Concerns on Intraorganizational Relationships

Abstract

The impact of liability concerns on social work practice in agency settings are discussed. Social work personnel face potential liability in areas ranging from clinical issues of improper referral or confidentiality to administrative issues of public & labor relations. A risk management paradigm involves identification of potential risk situations & comprehensive comparative analysis of options along ten criteria: (1) how each option contributes to the risk situation; (2) magnitude of danger; (3) probability of danger; (4) client preferences; (5) relative gains; (6) impact on treatment process; (7) resource consumption; (8) impact on public confidence in agency; (9) feasibility; & (10) appropriateness for specific client. This paradigm bases risk management decisions on expertise rather than authority, but requires that social workers be cross-trained in the administrative concerns of social welfare organizations. Clearly articulated agency value statements, implementation of a standard operating procedure for risk management, & collegial support are also important.
