Fidelity in Philanthropy: Two Challenges to Community Foundations
Abstract
Considers the challenges faced by modern philanthropic institutions
with regard to remaining faithful to the donor's charitable intent,
drawing on detailed examination of recent court cases involving the
Buck Trust in Marin County (CA) & the nonprofit Community Service
Society of New York. Discussed are three critical questions regarding
conditions for modifying donor's intent, nonprofits' rights to funds
earmarked for them by donors, & whether donors should disperse
funds directly or through foundations. The outcome of the Buck case,
which expanded giving beyond the intended area of Marin County,
demonstrates the issues underlying current trends in philanthropy --
eg, closer relationships between grant makers & recipients,
professionalization & expansion of philanthropy, & more
government oversight of philanthropic institutions. While the as yet
undecided Community Service Society case reflects similar issues, it
also illustrates trustee infidelity & weakening trust in community
foundations. Alternatives being pursued by donors include gift funds,
direct contributions, & limited lifespan community foundations.
Implications are briefly discussed in terms of dangers &
opportunities in alternative philanthropic approaches. Adapted from
